Terms of Service

Service: Marvelist (iOS and watchOS task, list, and organisation app)

Controller: Tophhie Cloud (United Kingdom)

These Terms govern your use of Marvelist, including the app, associated services, and any Marvelist Premium subscription. By downloading or using Marvelist, you agree to these Terms.

Who we are

Marvelist is a task management and personal organisation app for iOS and watchOS, developed by Tophhie Cloud (United Kingdom). Marvelist is offered as a free app with an optional paid tier — Marvelist Premium — available via the Apple App Store and directly through our web subscription model.

Accepting these terms

By creating an account or using the Marvelist app, you accept these Terms. If you don't agree, please don't use the app.

Eligibility

You must be 13 or older (and old enough to enter a binding agreement where you live) to use Marvelist.

Your account

You are responsible for keeping your login credentials secure.
You are responsible for all activity that occurs under your account.
Notify us promptly at help@marvelist.co.uk if you suspect your account has been compromised.
We reserve the right to suspend or terminate accounts that violate these Terms.

Your content

You own all content you create within Marvelist — your lists, tasks, and personal data. By using Marvelist, you grant Tophhie Cloud a limited, non-exclusive, royalty-free licence to store, process, and display your content solely to operate and deliver the service to you. We do not sell your content.

Marvelist Premium

Marvelist Premium is an optional paid subscription that unlocks additional features. Premium subscriptions are available through two channels:

Via the Apple App Store

Purchases made through the Apple App Store are subject to Apple's Terms and Conditions and Apple's standard billing, cancellation, and refund policies. Tophhie Cloud has no visibility into or control over App Store transactions. For refund requests on App Store purchases, you must contact Apple directly.

Via our web subscription (marvelist.co.uk)

Subscriptions purchased directly through our website are processed by Paddle.com Market Limited ("Paddle"), who act as the Merchant of Record for all web transactions. Your purchase contract for web subscriptions is with Paddle, not Tophhie Cloud. Paddle's terms and privacy policy apply to the transaction itself. Subscription management, including cancellation, is available via your account settings or through the Paddle billing portal. Refunds for web subscriptions are subject to the Marvelist Refund Policy, available at trust.tophhie.cloud.

Premium access is tied to your Marvelist account. If you cancel your subscription, you will retain Premium access until the end of your current billing period.

Acceptable use

You agree not to:

Use Marvelist for any unlawful purpose or in violation of any applicable law
Attempt to reverse-engineer, copy, or tamper with the app or its backend systems
Use the app to harm, harass, or abuse others
Upload or distribute malware or harmful code through the service
Attempt to gain unauthorised access to any systems or accounts

We reserve the right to remove content or restrict access in order to protect users and the integrity of the service.

Third-party services

Marvelist integrates with certain third-party services — including Apple Push Notification service (APNs), OneSignal for push notification delivery, and our backend infrastructure. These services have their own terms and privacy practices. Tophhie Cloud is not responsible for third-party services beyond what is described in our Privacy Policy.

Availability

We aim to keep Marvelist reliable and available, but we cannot guarantee uninterrupted access. Maintenance, updates, and unforeseen issues may cause temporary downtime. We will communicate planned maintenance where possible.

Intellectual property

All intellectual property in and to Marvelist — including the app, its design, branding, and codebase — is owned by or licensed to Tophhie Cloud. You are not granted any right to copy, modify, distribute, or reverse-engineer any part of Marvelist.

Privacy

Your personal data is handled in accordance with the Marvelist Privacy Policy, available at trust.tophhie.cloud. We process your data under UK GDPR. Contact privacy@tophhie.cloud to exercise your data rights.

Warranties and disclaimers

Marvelist is provided "as is" and "as available." To the maximum extent permitted by law, we disclaim all warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of liability

To the extent permitted by law, Tophhie Cloud will not be liable for indirect, consequential, or incidental damages, or for loss of data. Our total aggregate liability arising from your use of Marvelist will be capped at the greater of £100 or the amount you paid to Tophhie Cloud directly in the 12 months prior to the claim.

This limitation does not affect any rights you have under applicable consumer protection law.

Changes to these terms

We may update these Terms from time to time. When changes are material, we will notify you via push notification and/or email before they take effect. Continued use of Marvelist after the effective date constitutes acceptance of the updated Terms.

Governing law

These Terms are governed by the laws of England and Wales. Courts in England and Wales have exclusive jurisdiction over any disputes arising from these Terms.
